1. Acceptance of Terms

Plain English Summary: By browsing getosmera.store or placing an order, you agree to these terms. You need to be at least 18 (or have a parent's permission) to buy from us. If you don't agree, please don't use the store.

These Terms of Service ("Terms") govern your access to and use of the website at getosmera.store, including all related pages, content, features and checkout (together, the "Store"), and your purchase of any products from OSMERA, the trade name of the operator identified in our Legal Notice ("OSMERA", "we", "us" or "our").

By accessing the Store or placing an order, you agree to be bound by these Terms and by the policies referenced in them, including our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, do not use the Store.

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under that age, you may use the Store only with the involvement of a parent or legal guardian. You may not use the Store if you are under 13.

2. Description of the Store

Plain English Summary: We sell reverse-osmosis water purifiers online and ship them within the contiguous United States. We work hard to keep the store running and the information accurate, but we can't promise it'll never be down or that we'll never make a typo.

OSMERA sells water purification products through the Store. We currently ship to addresses in the contiguous United States only (the 48 contiguous states and the District of Columbia). We do not ship to Alaska, Hawaii, Puerto Rico, other US territories, APO/FPO addresses or outside the United States.

We aim to keep the Store available at all times but do not guarantee uninterrupted access. We may modify, suspend or discontinue any part of the Store, or any product, at any time.

3. Customer Accounts

Plain English Summary: You can check out as a guest. If you sign in to view your orders, keep your email account secure, because that's how you sign in. Give us accurate details so your order reaches you.

You may place orders without creating an account. If you sign in to view your orders, you do so using a one-time code sent to your email address. You are responsible for keeping access to that email account secure and for all activity carried out through it.

You agree to provide accurate, current and complete information when placing an order, including your shipping address and contact details. We are not responsible for orders delayed or lost because of incorrect information you provide.

We may refuse service, suspend access or cancel orders where we reasonably suspect fraud, abuse or a violation of these Terms.

4. Products

Plain English Summary: We describe our purifiers as accurately as we can. Install and use them following the manual, with the right plumbing and power, and never with water that's unsafe to begin with. They're water filters, not medical devices.

4.1 Product information

We make reasonable efforts to describe and display our products accurately, including their specifications, features and images. Colors may vary slightly depending on your screen. If a product you receive does not match its description, your remedy is set out in our Refund Policy.

4.2 Electrical and installation requirements

Our products are intended for use on standard US household electrical supply (110–120 V, 60 Hz), as stated on each product page. Under-sink models require a connection to a cold-water line, a drain connection, a power outlet under the sink and, where applicable, a hole for the dedicated faucet. You are responsible for confirming that your home meets these requirements before purchase, and for installing and using the product according to its user manual and any applicable local plumbing and electrical codes. If you are unsure, consult a licensed plumber or electrician.

4.3 Water quality

Reverse-osmosis performance depends on your incoming water supply, its pressure and temperature, and on replacing filter cartridges as directed. Do not use our products with water that is microbiologically unsafe or of unknown quality without adequate disinfection before or after the system. Product information on the Store is not a guarantee of any specific water-quality result. Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease.

4.4 Availability

All products are subject to availability. We may limit quantities, discontinue products or refuse any order at our discretion.

5. Orders, Pricing and Payment

Plain English Summary: Prices are in US dollars. Your order is confirmed when we accept it, not when you click "Pay". If we made an obvious pricing mistake, we'll cancel and refund you. Sales tax is added at checkout where required.

5.1 Orders

Your order is an offer to buy. We accept it when we send you a shipping confirmation, or earlier where we expressly confirm acceptance. We may decline or cancel any order, including after payment, for example where a product is unavailable, a pricing or description error has occurred, or we suspect fraud. If we cancel an order you have paid for, we will refund the full amount to your original payment method.

5.2 Prices

All prices are in US dollars. Prices may change at any time, but changes do not affect orders we have already accepted. If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you.

5.3 Payment

We accept the payment methods shown at checkout, which may include major credit and debit cards, Shop Pay, Apple Pay and Google Pay. Payments are processed by Shopify and its payment partners; we do not store your full card details. By submitting payment, you confirm you are authorized to use the payment method.

5.4 Taxes

Applicable sales tax is calculated and shown at checkout based on your shipping address.

5.5 Discount codes and promotions

Discount codes and promotional offers are valid only during their stated period and under their stated conditions, including any end date shown on the Store. Unless stated otherwise, codes are limited to one use per customer, cannot be combined with other offers, have no cash value, cannot be applied to past orders and may be withdrawn if obtained or used in violation of these Terms. If you return a discounted item, the refund is the amount you actually paid.

5.6 Subscriptions (when available)

If we offer automatically renewing purchases, such as filter replacement plans, the price, delivery frequency, the fact that the plan renews automatically until you cancel, and how to cancel will be clearly disclosed before you subscribe, and you will be asked for your express consent. You may cancel at any time as described at the time of purchase, and cancellation takes effect before the next scheduled charge if made within the stated cut-off.

6. Shipping, Returns and Refunds

Plain English Summary: Shipping is free within the contiguous US. You can return unused items within 30 days. If something arrives damaged or wrong, tell us and we'll make it right. The full details are in our Shipping and Refund Policies.

Shipping is governed by our Shipping Policy, and returns and refunds by our Refund Policy, both of which form part of these Terms. In summary: shipping is free to addresses in the contiguous United States; unused products in their original packaging may be returned within 30 days of delivery; return shipping is paid by the customer unless the item arrived damaged, defective or incorrect; and damaged, defective or incorrect items should be reported to support@getosmera.store within 7 days of delivery with photos.

Title to and risk of loss for products pass to you upon delivery to your shipping address.

7. Intellectual Property

Plain English Summary: The OSMERA name, logo, website design, photos and text belong to us or our licensors. You're welcome to browse and buy; please don't copy them.

The Store and all of its content, including the OSMERA name and logo, text, graphics, design, photographs and software, are owned by or licensed to OSMERA and are protected by intellectual property laws. Third-party product names and trademarks that may appear on products or packaging belong to their respective owners.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Store for your personal, non-commercial shopping. You may not copy, reproduce, modify, distribute, scrape or create derivative works from any part of the Store without our prior written permission, or use our name or logo in a way that suggests endorsement.

8. Reviews and Communications You Send Us

Plain English Summary: If you send us feedback or a review, you're letting us use it. Keep it honest and legal.

If you submit reviews, comments, ideas or other content to us ("Submissions"), you grant OSMERA a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display and adapt those Submissions in connection with the Store and our marketing, and you confirm that you have the right to grant this license and that your Submissions are truthful and lawful. We may remove any Submission at our discretion. We will not alter the meaning of a review or publish it without disclosing any incentive provided for it.

9. Prohibited Uses

Plain English Summary: Use the store honestly. No fraud, no hacking, no bots, no reselling our content.

You agree not to:

  • use the Store for any unlawful purpose or in violation of these Terms;
  • place fraudulent orders or use payment methods you are not authorized to use;
  • impersonate any person or misrepresent your identity;
  • harass, abuse or threaten our staff or other users;
  • send spam or unsolicited communications through the Store;
  • upload or transmit viruses, malware or any harmful code;
  • attempt to gain unauthorized access to the Store, its systems or other users' information, or circumvent any security measure;
  • use bots, scrapers or automated means to access or copy the Store or its content;
  • infringe our or any third party's intellectual property rights; or
  • purchase products for commercial resale without our prior written consent.

10. Privacy and Data Protection

Plain English Summary: We collect only what we need to process your order and run the store. The details are in our Privacy Policy. If you live in California or the EU, you have extra rights, and we'll honor them.

Our collection and use of personal information is described in our Privacy Policy, available at getosmera.store/policies/privacy-policy, which forms part of these Terms. We use cookies and similar technologies as described in the Privacy Policy and the cookie banner shown on the Store.

10.1 California residents (CCPA/CPRA)

If you are a California resident, you have the right to:

  • know what personal information we collect, use and disclose;
  • request deletion of your personal information;
  • request correction of inaccurate personal information;
  • opt out of the "sale" or "sharing" of your personal information, including through a "Do Not Sell or Share My Personal Information" link and by browser signals such as Global Privacy Control; and
  • not be discriminated against for exercising these rights.

To exercise these rights, email support@getosmera.store. We will verify your request and respond within the time required by law.

10.2 Users in the EU/EEA and UK (GDPR)

The Store is operated from Spain, and we process your personal data on the basis of performing our contract with you, our legitimate interests, your consent (for marketing) and our legal obligations. You have the right to access, rectify, erase, restrict, port and object to the processing of your personal data, and to withdraw consent at any time. You may lodge a complaint with your local data protection supervisory authority. Your data may be processed in the United States and other countries by our service providers, including Shopify, under appropriate safeguards. The data controller is the operator identified in our Legal Notice.

11. Disclaimers and Limitation of Liability

Plain English Summary: Apart from what the law requires and what we promise in our policies, we don't make extra promises about the products. If something goes wrong, our liability is limited to what you paid for the product. Some states don't allow these limits, so they may not apply to you.

11.1 Disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR OUR POLICIES, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE STORE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", AND OSMERA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Any warranty provided by a product's manufacturer is provided by that manufacturer, not by OSMERA.

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11.2 Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OSMERA AND ITS OWNERS, EMPLOYEES, SUPPLIERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE STORE OR ANY PRODUCT, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

11.3 Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, pandemics, epidemics, war, terrorism, civil unrest, labor disputes, government actions, carrier delays, customs holds, internet or utility failures, or supplier disruptions. In such cases we will notify you and, where we cannot ship within a reasonable time, offer you the option to cancel for a full refund.

12. Indemnification

Plain English Summary: If you break these terms or the law and someone comes after us because of it, you agree to cover the costs.

You agree to indemnify and hold harmless OSMERA and its owners, employees and agents from any claims, losses, damages and reasonable legal fees arising from (a) your violation of these Terms, (b) your violation of any law or third-party right, or (c) any Submission you provide. We may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with our defense. This section does not apply to claims arising from our own negligence or misconduct.

13. Termination

Plain English Summary: You can stop using the store any time. We can block access if someone breaks these terms. Orders you've already received stay covered by our policies.

You may stop using the Store at any time and may ask us to delete your account information by emailing support@getosmera.store, subject to records we must keep by law (for example, for tax and accounting).

We may suspend or terminate your access to the Store at any time if you violate these Terms or if we reasonably suspect fraud or abuse. Sections that by their nature should survive termination, including Sections 5.5, 7, 8, 11, 12, 14 and 16, will survive.

14. Dispute Resolution

Plain English Summary: If you have a problem, email us first and give us 30 days to fix it. Most things get solved that way. These terms follow Spanish law, but you keep every consumer protection your own state gives you.

14.1 Informal resolution

Before filing any claim, you agree to contact us at support@getosmera.store with a description of the issue and the resolution you seek. We will try in good faith to resolve it within 30 days.

14.2 Governing law

These Terms are governed by the laws of Spain. This choice of law does not deprive you of the protection of the mandatory consumer laws of the state or country where you live, and you may bring a claim in the courts of your place of residence where those laws allow it.

15. Changes to These Terms

Plain English Summary: We may update these terms. The version in effect when you placed your order applies to that order. Big changes will be clearly flagged.

We may update these Terms from time to time. The updated version will be posted on the Store with a new "Last Updated" date. Material changes will be highlighted on the Store, and where we have your email address, notified to you, at least 30 days before they take effect. The Terms in effect at the time you place an order apply to that order. Continued use of the Store after changes take effect constitutes acceptance of the updated Terms.

16. General Provisions

Plain English Summary: The standard legal details: these terms are the whole agreement, if one part is invalid the rest still applies, and emails count as written notice.

  • Entire agreement. These Terms and the policies referenced in them are the entire agreement between you and OSMERA regarding the Store.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of it.
  • Assignment. We may assign these Terms in connection with a merger, acquisition or sale of assets. You may not assign them without our consent.
  • Relationship. Nothing in these Terms creates a partnership, agency, employment or joint venture relationship.
  • Headings. Headings are for convenience only.
  • Electronic communications. You consent to receive communications from us electronically, and agree that electronic notices satisfy any legal requirement for written communication.
